Supreme Court Limits Gun Control In New York - Blue States Fight For Gun Control

Updated: Jul 12, 2022

On June 23 2022, the Supreme Court ruled in a 6-3 court that, "An individual who wants to carry a firearm outside his home may obtain an unrestricted license to 'have and carry' a concealed 'pistol or revolver' if he can prove that 'proper cause exists' for doing so." They have defined a "proper cause" as such, "demonstrating a special need for self-protection distinguishable from that of the general community."

According to the second amendment of the United States Constitution, "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." The Supreme Court has interpreted this as meaning that concealment of arms should not, and will not be tolerated on the state level. Many states in the USA have limited guns by making it so that for one to bear concealed weapons, they must have a "good cause" of doing so.

Many states continue to enact gun control laws, despite the recent ruling. "I just signed a new law to keep New Yorkers safe -- even in the face of a monumental setback from the Supreme Court," New York State governor Kathy Hochul tweets. Many states are trying to fight back against the new ruling, many say that they are attempting to keep their citizens safe.

"we cannot allow New York to become the wild, wild west."

President Joe Biden had stated that he is "deeply disappointed" in the ruling. New York City Mayor Eric Adams said that "we cannot allow New York to become the wild, wild west."

It appears that many big Democratic party members are stepping up to the stage, and fighting against the ruling. However, what do the Republicans have to say about this ruling?

According to Nina Totenberg, Justice Brett Kavanaugh had outlined a very important point of the ruling, saying that the ruling does not prevent states from requiring a license to carry a handgun in self defense. Totenberg says that Kavanaugh mentions the reason why New York's may-issue regime was unconstitutional was because it had required applicants for a license to have special needs other than self-defense as a reason to obtain a license.

As New York fights to defend its gun control laws, other blue states, like California and Hawaii, seek to do the same.

Stay tuned for more news on this matter.
